This article discusses ethical issues which are raised as a result of the introduction of economic evidence in mental health care in order to rationalise clinical practice. Cost effectiveness studies and guidelines based on such studies are often seen as impartial, neutral instruments which try to reduce the influence of non-scientific factors. However, such rationalising instruments often hide normative assumptions about the goals of treatment, the selection of treatments, the role of the patient, and the just distribution of scarce resources. (...) These issues are dealt with in the context of increased control over clinical practice by third parties. In particular, health insurers have a great interest in economic evidence in clinical care settings in order to control access to and quality of health care. The authors conclude that guideline setting and cost effectiveness analysis may be seen as important instruments for making choices in health care, including mental health care, but that such an approach should always go hand in hand with a social and political debate about the goals of medicine and health care. This article is partly based on the results of a research project on the normative aspects of guideline setting in psychiatry and cardiology which was conducted under the guidance of the Royal Dutch Medical Association. This paper explores the use of advance directives in clinical dementia research. The focus is on advance consent to participation of demented patients in non-therapeutic research involving more than minimal risks and/or burdens. First, morally relevant differences between advance directives for treatment and care, and advance directives for dementia research are discussed. Then attention is paid to the philosophical issue of dementia and personal identity, and the implications for the moral authority of research advance directives. Thirdly, a number of practical (...) shortcomings of advance directives for non-therapeutic dementia research are explored and attention is paid to the role of proxies. It is concluded that upon a closer look the initial attractiveness of advance directives for dementia research is lessened, and that it is doubtful whether these instruments can compensate for the lack of subject consent in case of non-therapeutic dementia research involving more than minimal risks and/or burdens for the incompetent demented subject. This article presents an overview ofregulations, guidelines and societal debates ineight member states of the EC about a)embryonic and fetal tissue transplantation(EFTT), and b) the use of human embryonic stemcells (hES cells) for research into celltherapy, including `therapeutic' cloning. Thereappears to be a broad acceptance of EFTT inthese countries. In most countries guidance hasbeen developed. There is a `strong' consensusabout some of the central conditions for `goodclinical practice' regarding EFTT.International differences concern, amongstothers, some of the informed consent issuesinvolved, and the (...) questions whether anintermediary organisation is necessary, whetherthe methods of abortion may be influenced bythe possible use of EFT, and whether EFTTshould only be used for the experimentaltreatment of rare disorders. The potential useof hES cells for research into cell therapy hasgiven a new impetus to the debate about (human)embryo research. The therapeutic prospects withregard to the retrieval and research use of hEScells appear to function as a catalyst for theintroduction of less restrictive regulationsconcerning research with spare embryos, atleast in some European countries. It remains tobe seen whether the prospect of treatingpatients suffering from serious disorders withtransplants produced by therapeutic cloningwill decrease the societal and moral resistanceto allowing the generation of embryos for`instrumental' use. Coercion and pressure in mental healthcare raise moral questions. This article focuses on moral questions raised by the everyday practice of pressure and coercion in the care for the mentally ill. In view of an example from literature—the story of Ulysses and the Sirens—several ethical issues surrounding this practice of care are discussed. Care giver and patient should be able to express feelings such as frustration, fear and powerlessness, and attention must be paid to those feelings. In order to be (...) able to evaluate the intervention, one has to be aware of the variety of goals the intervention can aim at. One also has to be aware of the variety of methods of intervention, each with its own benefits and drawbacks. Finally, an intervention requires a context of care and responsibility, along with good communication and fair treatment before, during and after the use of coercion and pressure. (shrink)

Avoiding whinges from various and potentially conflicting stakeholders is a major challenge for sustainable development and for the identification of sustainability scenarios or policies for biodiversity and ecosystem services. It turns out that independently complying with whinge thresholds and constraints of these stakeholders is not sufficient because dynamic ecological-economic interactions and uncertainties occur. Thus more demanding no whinge standards are needed. In this paper, we first argue that these new boundaries can be endogenously exhibited with the mathematical concepts of viability (...) kernel and viable controls. Second, it is shown how these no whinge kernels have components, such as harvesting of resources, that should remain within safe corridor while some other components, in particular biodiversity, have only lower conservation limits. Thus, using radar charts, we show how this no whinge kernels can take the shape of a tree that we name viability tree. These trees of viability capture the idea that the unbounded renewal potential of biodiversity combined with a bounded use of the different ecosystem services are crucial ingredients for the sustainability of socio-ecosystems and the design of no whinge policies reconciling the different stakeholders involved. In their recently published book Nudge (2008) Richard H. Thaler and Cass R. Sunstein (T&S) defend a position labelled as ‘libertarian paternalism’. Their thinking appeals to both the right and the left of the political spectrum, as evidenced by the bedfellows they keep on either side of the Atlantic. In the US, they have advised Barack Obama, while, in the UK, they were welcomed with open arms by the David Cameron's camp (Chakrabortty 2008). I will consider the following questions. What (...) is Nudge? How is it different from social advertisement? Does Nudge induce genuine preference change? Does Nudge build moral character? Is there a moral difference between the use of Nudge as opposed to subliminal images to reach policy objectives? And what are the moral constraints on Nudge? (shrink)

1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)

The paper surveys the currently available axiomatizations of common belief (CB) and common knowledge (CK) by means of modal propositional logics. (Throughout, knowledge- whether individual or common- is defined as true belief.) Section 1 introduces the formal method of axiomatization followed by epistemic logicians, especially the syntax-semantics distinction, and the notion of a soundness and completeness theorem. Section 2 explains the syntactical concepts, while briefly discussing their motivations. Two standard semantic constructions, Kripke structures and neighbourhood structures, are introduced in Sections (...) 3 and 4, respectively. It is recalled that Aumann's partitional model of CK is a particular case of a definition in terms of Kripke structures. The paper also restates the well-known fact that Kripke structures can be regarded as particular cases of neighbourhood structures. Section 3 reviews the soundness and completeness theorems proved w.r.t. the former structures by Fagin, Halpern, Moses and Vardi, as well as related results by Lismont. Section 4 reviews the corresponding theorems derived w.r.t. the latter structures by Lismont and Mongin. A general conclusion of the paper is that the axiomatization of CB does not require as strong systems of individual belief as was originally thought- only monotonicity has thusfar proved indispensable. Section 5 explains another consequence of general relevance: despite the "infinitary" nature of CB, the axiom systems of this paper admit of effective decision procedures, i.e., they are decidable in the logician's sense. An important factor in judging whether two retinal images arise from the same object viewed from different positions may be the presence of certain properties or cues that are 'qualitative invariants' with respect to the natural transformations, particularly affine transformations, associated with changes in viewpoint. To test whether observers use certain affine qualitative cues such as concavity, convexity, collinearity, and parallelism of the image elements, a 'same-different' discrimination experiment was carried out with planar patterns that were defined by four points (...) either connected by straight line segments (line patterns) or marked by dots (dot patterns). The first three points of each pattern were generated randomly; the fourth point fell on their diagonal bisector. According to the position of that point, the patterns were concave, triangular (three points being collinear), convex, or parallel sided. In a 'same' trial, an affine transformation was applied to one of two identical patterns; in a 'different' trial, the affine transformation was applied after the point lying on the diagonal bisector was perturbed a short, fixed distance along the bisector, inwards for one pattern and outwards for the other. Observers' ability to discriminate 'same' from 'different' pairs of patterns depended strongly on the position of the fourth, displaced, point: performance varied rapidly when the position of the displaced point was such that the patterns were nearly triangular or nearly parallel sided, consistent with observers using the hypothesised qualitative cues. The experimental data were fitted with a simple probabilistic model of discrimination performance that used a combination of these qualitative cues and a single quantitative cue. (shrink)

Currently, the widely used notion of activity is increasingly present in computer science. However, because this notion is used in specific contexts, it becomes vague. Here, the notion of activity is scrutinized in various contexts and, accordingly, put in perspective. It is discussed through four scientific disciplines: computer science, biology, economics, and epistemology. The definition of activity usually used in simulation is extended to new qualitative and quantitative definitions. In computer science, biology and economics disciplines, the new simulation activity definition (...) is first applied critically. Then, activity is discussed generally. In epistemology, activity is discussed, in a prospective way, as a possible framework in models of human beliefs and knowledge. (shrink)

A coherent story is a story that fits together well. This notion plays a central role in the coherence theory of justification and has been proposed as a criterion for scientific theory choice. Many attempts have been made to give a probabilistic account of this notion. A proper account of coherence must not start from some partial intuitions, but should pay attention to the role that this notion is supposed to play within a particular context. Coherence is a property of (...) an information set that boosts our confidence that its content is true ceteris paribus when we receive information from independent and partially reliable sources. We construct a measure cr that relies on hypothetical sources with certain idealized characteristics. A maximally coherent information set, i.e. a set with equivalent propositions, affords a maximal confidence boost. cr is the ratio of the actual confidence boost over the confidence boost that we would have received, had the information been presented in the form of maximally coherent information, ceteris paribus. This measure is functionally dependent on the degree of reliability r of the sources. We use cr to construct a coherence quasi-ordering over information sets S and S’: S is no less coherent than S’ just in case c_r is not smaller than c_r for any value of the reliability parameter. We show that, on our account, the coherence of the story about the world gives us a reason to believe that the story is true and that the coherence of a scientific theory, construed as a set of models, is a proper criterion for theory choice. This article addresses the role of auditory-related verbs in the work of Jean-Luc Nancy and Pierre Schaeffer in order to shed light on a broader tendency in French thought. Through a comparative reading of the ways in which Nancy, in Listening, and Schaeffer, in Treatise on Musical Objects, mobilize verbs such as écouter and entendre, I connect the issue of language to debates about descriptive and prescriptive approaches towards listening. Drawing on the Dictionary of Untranslatables, I argue that Nancy's and (...) Schaeffer's engagements with listening can be mapped onto historical modes of framing politics and ethics, which are also characterized by descriptive and prescriptive approaches. By showing how theories of listening connect to political and ethical debates, this study discusses the ideological instrumentalization of listening as opposed to more descriptive and exploratory forms of engagement in the auditory and the faculty of the ear. ‘We are before Dante’: In this interview, held via email in March 2020 amid the massive outbreak of the COVID-19 pandemic, Jean-Luc Nancy leads us on a brief but far-reaching foray through his thought. He succeeds in providing an overview of the subjects that he has raised since the beginning of his career as a philosopher, while maintaining a focus on their pertinence for what we are currently facing in the world today. He supplements his insight that ‘we are before (...) Dante’ with the equally remarkable conclusion: ‘Desire is what is born par excellence’. In between these two propositions, and in between the lines and words documented here – touching upon topics as diverse as the moai statues of Easter Island, the music of Schumann, Wagner, and techno, as well as the writing of Artaud, Proust, and Verlaine – we find an exciting, up-to-date treatment of the question of how to ‘deal with the world intellectually’ (Musil) without, in doing so, participating in the modern claim to ‘master’ it. Instead, Nancy suggests, we ought to be attentive to what escapes us by its very principle, with philosophy, literature, and art serving as witnesses of what has always been absent from our mind, that is, the sensibility of meaning, in order to become aware that, since we are always already before and after birth, ‘we come from nowhere and everywhere’. This realization enables us to understand the political consequences that it has for our understanding of a world in metamorphosis, including for highly controversial issues such as colonialism, anti-Semitism, the far right, neo-liberalism, and other totalitarian forms that supposedly manifest a return of the myth, as well as its consequences for the insurmountability of Marx(ism). Experience does not have boundaries; it is a boundary. Transgression, as envisaged by Bataille, consists in the realisation of this circumstance. Boundary experiences are experiences of the limit. The experience itself communicates the boundary; communication takes place at the boundary of two experiences. Following Bataille, Jean-Luc Nancy further developed this thought, arguing that in this impossible inner experience, a community of beings is communicated, or indicated, but cannot be translated into any specific (organisational) form of community, or concrete politics. Such (...) an ‘inoperative’ or ‘unrepresentable’ community is to be found in birth, love, and death. This paper will try to apply Derrida’s famous judgement of ascribing Bataille a Hegelianism without reserve, by reading Nancy’s thought mutatis mutandis as a Batailleanism with reserve. This coincides with a transition from a restricted natology – which presupposes an equivalence, or exchangeability, of birth and death – to a general natology. This represents a shift in Western philosophy’s thanatological tradition, which over the course of the twentieth century has gradually come to refuse such an easy equation in the wake of its discovery of birth as a philosophical phenomenon in its own right – independent of death. Jean Luc-Marion’s assertion that Heidegger has not sufficiently addressed the notion of gratitude and the Call is incorrect. Based on Heidegger’s discussion in What is Called Thinking? of thankfulness and its relation to thinking, I argue that Heidegger indeed articulates a place for gratitude as the proper situation, the proper attitude of phenomenology. While I make an apology for Heidegger, I also note, however, that Husserl’s own discussions require more authentic reappraisal within the context of Heidegger’s work, thereby reinforcing the (...) notion that gratitude has something to say in terms of the way phenomenology getsbuilt up over time, both in form and content. The article examines the surprising role of Rousseau in the revival of liberal and humanist thought in contemporary French political thought. The choice of Rousseau as an inspiration and source of humanism is an illuminating indication of a shift in French thought. The authors concentrate on the natural- rights republicanism of Luc Ferry and Alain Renaut and the critical humanism of Tzvetan Todorov. While these thinkers all appeal to Rousseau's definition of humanity in terms of freedom, they draw on different (...) aspects of his thought and his relationship to the philosophic tradition. Their different receptions of Rousseau reveal tensions in the humanist revival and provoke reflection on the relationships among republicanism, liberalism and humanism in contemporary France. If there is a k(n)-enumerator for h then h is called k(n)-enumerable. We also consider enumerators which are only A-recursive for some oracle A. We determine exactly how hard it is to enumerate the Kolmogorov function, which (...) assigns to each string x its Kolmogorov complexity: • For every underlying universal machine U, there is a constant a such that C is k(n)-enumerable only if k(n) ≥ n/a for almost all n. • For any given constant k, the Kolmogorov function is k-enumerable relative to an oracle A if and only if A is at least as hard as the halting problem. • There exists an r.e., Turing-incomplete set A such for every non-decreasing and unbounded recursive function k, the Kolmogorov function is k(n)-enumerable relative to A. The last result is obtained by using a relativizable construction for a nonrecursive set A relative to which the prefix-free Kolmogorov complexity differs only by a constant from the unrelativized prefix-free Kolmogorov complexity. Although every 2-enumerator for C is Turing hard for K, we show that reductions must depend on the specific choice of the 2-enumerator and there is no bound on the quantity of their queries. We show our negative results even for strong 2-enumerators as an oracle where the querying machine for any x gets directly an explicit list of all hypotheses of the enumerator for this input. The limitations are very general and we show them for any recursively bounded function g: • For every Turing reduction M and every non-recursive set B, there is a strong 2-enumerator f for g such that M does not Turing reduce B to f. • For every non-recursive set B, there is a strong 2-enumerator f for g such that B is not wtt-reducible to f. Furthermore, we deal with the resource-bounded case and give characterizations for the class ${\rm S}_{2}^{{\rm P}}$ introduced by Canetti and independently Russell and Sundaram and the classes PSPACE, EXP. • ${\rm S}_{2}^{{\rm P}}$ is the class of all sets A for which there is a polynomially bounded function g such that there is a polynomial time tt-reduction which reduces A to every strong 2-enumerator for g. • PSPACE is the class of all sets A for which there is a polynomially bounded function g such that there is a polynomial time Turing reduction which reduces A to every strong 2-enumerator for g. Interestingly, g can be taken to be the Kolmogorov function for the conditional space bounded Kolmogorov complexity. • EXP is the class of all sets A for which there is a polynomially bounded function g and a machine M which witnesses A ∈ PSPACEf for all strong 2-enumerators f for g. Finally, we show that any strong O(log n)-enumerator for the conditional space bounded Kolmogorov function must be PSPACE-hard if P = NP. (shrink)

The structural view of rational acceptance is a commitment to developing a logical calculus to express rationally accepted propositions sufficient to represent valid argument forms constructed from rationally accepted formulas. This essay argues for this project by observing that a satisfactory solution to the lottery paradox and the paradox of the preface calls for a theory that both (i) offers the facilities to represent accepting less than certain propositions within an interpreted artificial language and (ii) provides a logical calculus of (...) rationally accepted formulas that preserves rational acceptance under consequence. The essay explores the merit and scope of the structural view by observing that some limitations to a recent framework advanced James Hawthorne and Luc Bovens are traced to their framework satisfying the first of these two conditions but not the second. Faut-il le rappeler, Diogène Laërce, en dépit de sa notoriété et de son utilité pour l'étude de la philosophie ancienne, reste un auteur peu traduit et peu édité. Pour s'en tenir à l'époque moderne et aux traductions complètes, le lecteur francophone n'avait guère à sa disposition, jusqu'ici, que les traductions de Zévort et de (...) Genaille. La première remonte au milieu du XIXre siècle. La seconde, de 1933, suit l'édition de Cobet, et se révèle très insatisfaisante. Parmi ses nombreuses et incontestables qualités, on remarquera, au premier chef, que l'éditrice a su s'entourer de spécialistes de tout premier ordre. Citons les noms de Luc Brisson, de Michel Narcy, de Jacques Brunschwig et de Jean-François Balaudé, auteur d'une traduction remarquée des trois lettres et des Maximes capitales d'Épicure. (shrink)
